You most likely hear it all the time. Someone is going bankrupt or losing just about everything that they own because some one has sued them. There are all types of reasons why one person is going to sue another; there are also many similar reasons why customers sue a business. If you want protection for your family, business and your future read and take action involving your own finances and insurance for protection you can rely on.
In the society that we live in, anyone is suing everyone or any business for just about anything that goes wrong, or that they think is wrong. To protect yourself from financial ruin:
Seek legal advice when someone serves you with papers that you are going to be sued. It is the lawyer’s job to get you out of problems and to solve problems for you with out losing everything that you have. An estate-planning lawyer is going to be able to help you protect your assets when you are most vulnerable to being sued often. Your lawyer is going to be able to review the paper work if you are being sued and they will tell you all about your options. While you might think you have no options, often you have some.
Your teen is a source of potential lawsuits against you, even if they are a good, safe child. Your teen could be out driving, hurt or kill someone when driving the car, and the other people can come back to sue you as the parent or guardian. It is important to limit the driving that your teen does, where your teen drives, and to stress the importance to your teen about safe driving habits. Set curfews if needed, to protect your children from harms ways and to prevent your children from possibly hurting others – limiting your risk to lawsuits.
If you have your home worked on, your cars worked on, or if you are having extensive work done in any other manner get everything written down. Put all contracts in writing when ever possible. When you owe someone else money, and they sue you for money, you are only liable for what payment you stated in the contract that you did not pay, if proven. Limit how those who work for you can sue you when you have a written contract stating how much you will owe and when it will be paid.
If you are a subcontractor, a service business or if you work for others in any capacity, get a contract. A written contract that states the time or amount of warranty and the work that was to be completed for a stated amount, you are less likely to be sued for work not done, or work done but done wrong. Avoid misunderstandings and lawsuits by using contacts wherever possible.
Remember that all types of oral agreements can lead to misinterpretations. Always get it in writing if you are promised something or if you in turn promise another person something.
The sidewalk and the yard out front of your home can be a possible lawsuit waiting to happen if you are not careful. Look for potholes, and fill them in along the sidewalk. The sidewalk is a homeowner’s responsibility.
Be sure that your children do not play near the neighbor’s cars, trucks, or their home. Prevention is the key to not having a lawsuit put against you in case of an accident or problem involving where your children where playing and possible things that they may have done, said or broke. This also applies to you, as the parent or neighbor, with your own toys that could cause damage to another person’s property. Limiting your liability to your yard, your home and not your neighbors is going to be good prevention.
